“No-Fault” Divorce

Under Florida’s “no-fault” divorce system, a spouse can seek to dissolve a marriage without having to blame the other spouse for the split. Instead, the person need only show that the marriage was legal, that one of the parties has been residing in Florida for at least the last six months, and that the marriage is irretrievably broken. Courts will also grant a divorce upon request when one of the spouses has become mentally incapacitated.

Divorcing spouses who do not have minor children can take advantage of a simplified divorce procedure where they agree on certain issues, including how their property will be divided and that neither spouse will seek alimony. Couples who do not qualify for the simplified version typically must appear before a local judge, who will hear testimony and consider evidence in order to rule on issues like property distribution, parenting plans, and child and spousal support.

Parenting Plans and Coordination

For divorcing spouses with minor children, some of the most common issues that come up during legal proceedings have to do with who will care for the kids. Florida law requires parents in these proceedings to come up with a detailed plan laying out where the child will live, how rearing duties will be handled, and how much time the child will spend with each parent. These parenting plans are meant to avoid long – and costly – court battles. As such, they may be best executed through collaborative negotiation. For spouses who have a hard time reaching an agreement, the state offers a parenting coordination program designed to ease the stress and potential conflict involved in the process.
